Terms of Service

Welcome to Dateful. These Terms of Service ("Terms") govern your use of the Dateful mobile app and related services (collectively, "Dateful"). Dateful is operated by Jason King ("we," "us," "our"), based in Madison, Wisconsin, USA. By creating an account or using Dateful, you agree to these Terms and to our Privacy Policy.

1. Eligibility

You must be at least 13 years old to use Dateful. By creating an account, you confirm you meet this age requirement. If you are between 13 and the age of majority in your jurisdiction, a parent or guardian must agree to these Terms on your behalf.

Dateful is rated 17+ on the App Store due to user-generated content and references to alcohol. We do not knowingly collect information from anyone under 13 — see our Privacy Policy.

2. Your account

You're responsible for everything that happens under your account. Keep your password safe, don't share it, and notify us at hello@trydateful.com if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms.

3. Your content

You retain ownership of the photos, captions, reviews, comments, and other content you post to Dateful ("Your Content"). By posting, you grant Dateful a worldwide, royalty-free, non-exclusive license to host, display, store, and distribute Your Content as needed to operate Dateful — including showing your content to your confirmed friends, generating share cards, and running automated moderation.

This license ends when you delete Your Content, except for content already shared with friends (which may remain in their feed cache) and backups retained for a reasonable period.

You represent that you own or have the right to post Your Content and that it does not infringe anyone else's rights.

4. Acceptable use

Dateful is a friendly place. Don't use it to:

• harass, threaten, stalk, or impersonate anyone
• post sexually explicit content, gore, hate speech, or content that promotes self-harm or violence
• post content involving anyone under 18 in an inappropriate context
• spam, scam, phish, or solicit other users
• post content that violates the law or anyone's intellectual property rights
• attempt to bypass moderation, security measures, or rate limits
• reverse-engineer, scrape, or build derivative services from Dateful
• use Dateful to advertise commercial services without our written permission

We use automated moderation (AWS Rekognition) to screen photos on upload. Reported content is reviewed within 24 hours. Accounts that violate these Terms may be suspended or terminated at our sole discretion.

5. Reporting and blocking

Every post and profile in Dateful has a Report option (via the "···" menu). Reports are reviewed within 24 hours. You can also Block any user — blocking removes friendship, cancels pending requests, and hides that user's content from your feed.

If you believe content on Dateful infringes your copyright, send a DMCA notice to hello@trydateful.com including: (1) your contact info, (2) identification of the copyrighted work, (3) the URL or location of the allegedly infringing content, (4) a good-faith statement that the use is not authorized, (5) a statement under penalty of perjury that you are authorized to act on the copyright owner's behalf, and (6) your signature (electronic is fine).

6. Service availability

Dateful is provided "as is." We do not guarantee uptime, accuracy of venue information, or that AI-generated date plans will suit your situation. Venue hours, specials, and events come from third-party sources and may be wrong or out of date. Always verify before you go.

We may change, suspend, or discontinue Dateful (or any feature) at any time without notice.

7. Pricing

Dateful is currently free. We may introduce paid features in the future (such as "Dateful Plus"). Free-tier limits — like a weekly generation cap — may change. We'll give reasonable notice before any change that materially affects your access.

8. Termination

You can delete your account at any time via Settings. We may suspend or terminate your account if you violate these Terms or otherwise harm Dateful or its users. Upon termination, we'll delete your personal data per our Privacy Policy, except as required for legal compliance.

9. Disclaimers

Dateful is provided "as is" and "as available" without warranties of any kind, express or implied. We disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement. We make no guarantee that the service will be error-free, secure, or continuously available.

10. Limitation of liability

To the fullest extent permitted by law, Dateful will not be liable for any indirect, incidental, consequential, or punitive damages, or any loss of profits or revenue. Our total liability for any claim arising from these Terms or your use of Dateful will not exceed one hundred US dollars ($100).

11. Indemnification

You agree to indemnify and hold Dateful (and Jason King) harmless from any claim, loss, or liability arising from Your Content, your use of Dateful, or your violation of these Terms.

12. Apple-specific terms

If you use Dateful on an Apple device, the following terms apply in addition to the rest of these Terms:

• These Terms are between you and Dateful, not Apple. Apple is not responsible for Dateful or its content.
• Apple has no obligation to provide support or maintenance for Dateful.
• If Dateful fails to conform to any applicable warranty, you may notify Apple, who will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Dateful.
• Apple is not responsible for addressing any claims arising from your use of Dateful, including product liability claims, regulatory non-compliance claims, or consumer-protection claims.
• Any third-party intellectual property claims regarding Dateful will be handled by Dateful, not Apple.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as a user.

13. Governing law

These Terms are governed by the laws of the State of Wisconsin, USA, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of Dateful will be resolved in the state or federal courts located in Dane County, Wisconsin, and you consent to the jurisdiction of those courts.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll notify you (via in-app notice, email, or update to the Effective date above). Continued use of Dateful after changes means you accept them.
